You can give your son his fathers name as long as neither one of you are married to someone else. If you are married to someone else (even if your seperated legally) or your boyfriend is; the baby cannot have his last name.

As far as I know, what ever you list on the birth certificate is what the baby’s name will be…so if you put the father’s last name as your baby’s last name….that’s what it should be. I have a friend who is married, lives in NC, but still uses her maiden name. All her children have her husband’s last name. You shouldn’t have a problem, just make sure the person fillout out the birth record puts down the information YOU want.

i’m from south carolina. here you can give the baby your last name or the father’s last name.but as long as the father signs the paternal papers b/c that shows that he is aware of the child being his and having his last name legally applied to another person. that shows his consent.
